Präambel Der Sorbische Künstlerbund e.V./ Zwjazk serbskich wuměłcow z.t. ist ein gemein-nütziger Verein, der sich die Aufgabe stellt, die sorbische Kunst zu pflegen, zu fördern, weiterzuentwickeln und zu verbreiten sowie Prozesse der Schaffung und Verwertung sorbischer Kunst zu begleiten. Er verfolgt keine wirtschaftlichen Zwecke.
§ 1 Der Sorbische Künstlerbund e.V. (im folgenden Bund) mit Sitz in Bautzen verfolgt ausschließlich und unmittelbar gemeinnützige Zwecke im Sinne des Abschnitts “Steuerbegünstigte Zwecke” der Abgabeordnung.
Zweck des Bundes ist die Pflege, Förderung, Weiterentwicklung und Verbreitung der sorbischen bildenden, angewandten und darstellenden Kunst, der Literatur, des sorbischen Film- und Musikschaffens und neuer elektronischer Kunstformen. Der Bund möchte damit die Kulturlandschaft Deutschlands bereichern und sich insbesondere jener Thematik zuwenden, die aus den kulturellen Interessen der sorbischen Bevölkerung hervorgeht. Weiterhin soll er den Erfahrungsaustausch und damit die Kreativität seiner Mitglieder fördern. Der Bund hat Brückenfunktion zu anderen Kulturen, besonders zu den slawischen und denen von Minderheiten.
Zur Erfüllung des Satzungszweckes dienen u. a. Veranstaltungen in Form von Ausstellungen, Kolloquien, Konzerten, Lesungen, Wettbewerben und Workshops, die Begleitung oder Unterstützung von Schaffensprozessen neuer künstlerischer Werke und die Beratertätigkeit in politisch-gesellschaftlichen Fachgremien.
§ 2 Der Bund ist selbstlos tätig. Er verfolgt nicht in erster Linie eigenwirtschaftliche Zwecke.
§ 3 Mittel des Bundes dürfen nur für die satzungsgemäßen Zwecke verwendet werden. Die Mitglieder erhalten keine Zuwendungen aus Mitteln des Bundes.
§ 4 Die Mitglieder haben keinen Anspruch auf Leistungen des Bundes, die sich aus dem Satzungszweck gem. § 1 ableiten lassen.
§ 5 Es darf keine Person durch Ausgaben, die dem Zweck des Bundes fremd sind, oder durch unverhältnismäßig hohe Vergütungen begünstigt werden.
§ 6 Auflösung des Bundes (1) Über die Auflösung des Bundes entscheidet die Mitgliederversammlung mit 2/3-Mehrheit der anwesenden Mitglieder. (2) Die Mitglieder des Bundes haben keinen Anspruch auf dasVermögen des Bundes oder die eingezahlten Beiträge. (3) Bei Auflösung der Körperschaft oder bei Wegfall steuerbegünstigter Zwecke fällt das Vermögen der Körperschaft an die Domowina, Bund Lausitzer Sorben e.V., Vereinsregisternummer 30317 gemäß Registrierung beim Amtsgericht Dresden, die es unmittelbar und ausschließlich zur gemeinnützigen Förderung der Kunst zu verwenden hat.
§ 7 Geschäftsjahr Das Geschäftsjahr des Bundes ist ein Kalenderjahr.
§ 8 Mitgliedschaft (1) Der Bund ist der Zusammenschluss ordentlicher und fördernder Mitglieder. (2) Ordentliches Mitglied kann jede natürliche und juristische Person sorbischer Nationalität sowie jede nicht rechtsfähige Personenvereinigung werden, dieals Künstler, Kultur- und Kunsthistoriker im Sinne der Präambel der Satzung wirkt. Weiterhin können auch Künstler deutscher und anderer Nationalität die Mitgliedschaft erwerben, wenn sie sich durch entsprechendes langjähriges künstlerisches oder kunsthistorisches sowie -kritisches Schaffen Verdienste erworben haben. (3) Über den schriftlich einzureichenden Aufnahmeantrag entscheidet der Vorstand. Die Annahme der Satzung und endgültige Mitgliedschaft wird vollzogendurchdie Zahlung des Mitgliedsbeitrags. (4) Förderndes Mitglied kann jede natürliche oder juristische Person werden, diesich dem Zweck des Bundes verpflichtet fühlt und diesen unterstützen will. Fördernde Mitglieder werden durch den Vorstand anerkannt und als solcheder Mitgliederversammlung bekanntgegeben. (5) Die Mitgliedschaft endet bei
Tod des Mitglieds;
schriftlich erklärtem Austritt zum Ende des laufenden Kalenderjahres, welcher mit einer Frist von drei Monaten vor Ablauf des Kalenderjahresan den Vorstand zu richten ist;
Beitragsrückstand von mindestens zwei Jahren
Ausschluss aus dem Verein gemäß § 8, Abs. 6.
(6) Verstößt ein Mitglied in erheblichem Maße gegen die in der Satzung enthaltenen Bestimmungen, kann durch Beschluss des Vorstandes sein Ausschluss erfolgen. Vor dem Ausschluss ist das betreffende Mitglied persönlich oder schriftlich zu hören. Das Mitglied hat das Recht, Berufung einzulegen.
§ 9 Arbeitskreise (1) Die Mitglieder des Bundes haben die Möglichkeit, interessenbedingte Arbeitskreise zu bilden, die in der Regel selbstständig arbeiten. (2) Die Arbeitskreise haben keine Rechtsfähigkeit nach außen.
§ 10 Organe des Bundes Die Organe des Bundes sind:
die Mitgliederversammlung
der Vorstand.
§ 11 Mitgliederversammlung (1) Die Mitgliederversammlung ist das oberste Organ des Bundes. Sie tagt in der Regel mindestens ein Mal im Jahr und wird vom Vorsitzenden bei Einhaltung einer Frist von 4 Wochen einberufen. In der Einladung ist die vom Vorstand festgesetzte Tagesordnung kundzutun. (2) Die wichtigsten Aufgaben der Mitgliederversammlung in Abhängigkeit von der jeweiligen Zielsetzung der Versammlung sind:
Wahl sowie Entlastung des Vorstandes und Beschlussfassung zur Wahlordnung
Entgegennahme des Rechenschaftsberichts des Vorstandes
Entgegennahme des Finanzberichts
Beschlussfassung über Satzungsänderungen und die Vereinsauflösung
Beschlussfassung über die Berufung eines Mitgliedes, wenn dieses durch den Vorstand ausgeschlossen bzw. wenn die Zustimmung über den Ausschluss durch den Vorstand gegeben wurde.
(3) Bei allen Abstimmungen, ausgenommen bei der Wahl des Vorsitzenden gemäß § 12, Abs. 4 wird mit einfacher Mehrheit entschieden. Es sind Ja-Stimmen, Nein-Stimmen und Stimmenenthaltungen zulässig. Stimmenenthaltungen werden weder den Ja-, noch den Nein-Stimmen hinzugezählt.
§ 12 Vorstand (1) Der Vorstand besteht aus dem Vorsitzenden, dem stellvertretenden Vorsitzenden, dem Schatzmeister und bis zu 4 Beisitzern. (2) Der Vorstand im Sinne von §26 BGB sind der Vorsitzende, der stellvertretende Vorsitzende und der Schatzmeister. (3) Der Bund wird in seinen Rechtsbeziehungen durch zwei Vorstandsmitglieder vertreten. Handlungen nur eines Vorstandsmitglieds im gerichtlichen und außergerichtlichen Verkehr sind nichtig. (4) Der Vorsitzende wird von der Mitgliederversammlung mit 2/3-Mehrheit der anwesenden Mitglieder auf die Dauer von vier Jahren gewählt. Kommt keine 2/3-Mehrheit zustande, wird ein zweiter Wahlgang durchgeführt, bei dem die einfache Mehrheit entscheidet. Der Vorstand wird von der Mitgliederversammlung mit einfacher Mehrheitder anwesenden Mitglieder auf die Dauer von vier Jahren gewählt. Die Amtszeit endet mit der Entlastung des bisherigen und der Wahl des neuen Vorstandes. (5) Bei Ausscheiden eines Vorstandsmitgliedes während der Amtszeit kann der Vorstand für den Rest der Amtszeit ein Ersatzmitglied kooptieren. (6) Der Vorstand führt die Beschlüsse der Mitgliederversammlung aus und koordiniert die Arbeit des Bundes. (7) Die Vorstandsmitglieder haben Anspruch auf Erstattung der Auslagen, die im unmittelbaren Zusammenhang mit der Arbeit des Bundes entstehen. (8) Streitigkeiten, die der Vorstand allein nicht klären kann, werden in der Mitgliederversammlung entschieden.
§ 13 Schatzmeister Der Schatzmeister verwaltet die Finanzen des Bundes und erstattet der Mitgliederversammlung einmal im Geschäftsjahr den Finanzbericht.
§ 14 Recht der Mitglieder Die Mitglieder des Bundes haben:
das Recht der Teilnahme an allen Veranstaltungen des Bundes;
aktives und passives Wahlrecht, sofern sie ordentliche Mitglieder sind;
entsprechend den Möglichkeiten und dem Zweck des Bundes, das Rechtauf Gewährung von juristischem Beistand durch den Bund in beruflichenund sozialen Angelegenheiten.
§ 15 Finanzierungsgrundlagen (1) Die Finanzierung des Bundes erfolgt aus den Beitragsgeldern der Mitgliederdes Bundes sowie aus öffentlichen Zuwendungen und privaten Spenden. (2) Öffentliche Zuwendungen sowie Spenden dürfen nicht an Bedingungen geknüpft sein, die dem Zweck des Bundes zuwiderlaufen.
§ 16 Mitgliedsbeiträge Die Höhe der jährlichen Mitgliedsbeiträge wird in einer Beitragsordnung gesondert geregelt. Die Beitragsordnung wird von der Mitgliederversammlung beschlossen.
